Having a patent is a good idea if you have an invention or exhibit that you are planning to market. While you are getting your materials finalized a patent protects other people from being able to act on it. Ideas can’t be patented so you have to have the actual idea in place before you are able to apply for one.
Patents have to be applied for with an application from the United States Patent Office. You can have one sent to you or fill one out online. There are three different types of patents that can be applied for. A utility patent covers all of the functional aspects of a product. This includes the processes for making the product take its final form. A design patent can be obtained to protect your various designs that will be used to market your products. There are also plant patents if you have discovered a new type of living plant that you don’t want other people to be able to market.
After you have filed the patent application it will be reviewed by a representative to ensure all of the information has been completed as outlined. It is vital that you have a completed application because it won’t be valid if any information that is required is missing. You also need to include drawings of your invention so that they may be reviewed.
Once the application has been initially reviewed for accurate information you will be notified that you need to send in the patent application fee. If there is missing information you will get a letter telling you want it is that is missing and the deadline for returning that information. If the information is not received by the deadline your patent request will be denied.
It is important to note that you must file a separate application for each patent you want to get. You may have several applications in place at the same time as long as you provide the right information and you pay the application fee for each one of them.
It can be frustrating waiting for a reply about on your patent status. Some of them are approved or denied within six months of the filing of a completed application. In other instances it can take several years for the response to be received. During this process though it is likely you will receive letters from the agency requesting clarification of information or further information in order to get your patent approved. Make sure you respond accurately and quickly to their requests so that the patent process can be completed.
